People who live in Sunny Isles Beach, Florida are a bit confused about what the laws and regulations are regarding cannabis use. This isn’t surprising. The law in Florida is pretty clear. Medical marijuana use is legal as long as you qualify for a medical marijuana card. The Florida statutes outline who qualifies for a medical marijuana card. Recreational marijuana use, on the other hand, is still illegal. If you’re caught using or selling marijuana or paraphernalia, there’s a very good chance you’ll be facing jail time. The laws are pretty strict when it comes to recreational marijuana use in the Sunshine State. As for the laws in Sunny Isles Beach, they’re the same as in the rest of Florida. Here, we’ll talk a bit about what you can and cannot do in Sunny Isles Beach when it comes to cannabis use. 

Marijuana for Recreational Use is Illegal in Sunny Isles 

It’s illegal to use cannabis in Florida for recreational use. The only people who are allowed to use cannabis are those who qualify for a medical marijuana card. If you’re caught with marijuana or any other cannabis product in Sunny Isles, you’ll face the following consequences: 

  • Possession of less than 20 grams will result in a fine of $100 for a first offense; $200 for a second offense; and $300 for a third offense. For all people with 3 or more offenses, they will have to attend a criminal court hearing and may fact criminal penalties. 
  • Delivery of less than 20 grams of marijuana is a misdemeanor. However, it does carry a fine of up to $1,000 and up to 1 year in jail. 
  • If you are caught selling or delivering any amount of marijuana within 1,000 feet of a school, college or park, you will be facing a felony. The fine is up to $10,000 and you can face up to 15 years in prison. 
  • If you’re caught selling more than 25 pounds of marijuana, you will be facing up to 5 years in jail and fines of up to $5,000 

The only people who can legally use cannabis products in Sunny Isles are those who carry a valid and current medical marijuana card. 

What Sorts of Cannabis Products Can People with a Medical Marijuana Card Use in Sunny Isles, Florida? 

If you hold a valid medical marijuana card in Sunny Isles, you’re allowed to use or purchase any of the cannabis products allowed by Florida law. Sunny Isles has chosen to align themselves with the state laws – unlike some of the other cities, like Miami, they do not want their residents smoking cannabis products. In fact, if you’re caught smoking marijuana in Sunny Isles, you’ll face the same penalties as someone without a medical marijuana card. 

In Sunny Isles, you’re allowed to purchase CBD oils and gummies at a legal dispensary. The THC concentration of these products must be less than 5%. If it’s higher than that, it is illegal according to Florida law. You also cannot purchase more than 2.5 grams of cannabis flower within a 35-day period. If you attempt to do this, you will face fines and the loss of your medical marijuana card. 

Will the Law in Sunny Isles Change Any Time Soon? 

The government in Sunny Isles has made it clear that they will not be changing their laws until the state laws in Florida change. They have stated that they follow the recommendations of the FDA and will wait until Florida changes their laws to modify their own municipal laws.
